1. Acceptance of Terms
By accessing or using smallswap ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to any part of these Terms, you must not use the Service.
2. Description of Service
smallswap is a cryptocurrency exchange service that facilitates swaps between Monero (XMR) and other cryptocurrencies. In the course of a swap, the Service temporarily receives funds from the user, conducts the exchange, and sends the resulting cryptocurrency to a user-provided destination address. Swaps are executed on a best-efforts basis; the Service does not guarantee timing, final rate, or completion of any individual swap.
3. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that your use of the Service does not violate any laws applicable to you.
4. No Account, No Identity Verification at the Front Door
The Service does not require user accounts or identity verification to initiate a swap. The Service may, however, require identity verification, proof of funds, or other information in specific circumstances described in Section 6.
5. User Responsibilities
You are solely responsible for:
- The accuracy of wallet addresses, amounts, and chain selections you provide. Cryptocurrency transactions are irreversible; the Service cannot recover funds sent to incorrect addresses.
- Any taxes, reporting obligations, or other legal duties arising from your use of the Service in your jurisdiction.
- Ensuring your use of the Service complies with all laws applicable to you.
- Safeguarding your own devices, wallets, and communication channels.
You agree not to use the Service to facilitate fraud, theft, sanctioned-party transactions, terrorism financing, ransomware payments, or any other activity prohibited by applicable law.
6. Compliance Screening and Discretionary Action
The Service performs automated screening of deposit and payout addresses against public sanctions lists (including but not limited to the U.S. Treasury OFAC Specially Designated Nationals list), publicly known mixer and darknet-marketplace clusters, and other compliance-relevant data sources. Screening may be performed by the Service directly or by third-party compliance providers.
Where a swap is flagged by this screening, the Service reserves the right, in its sole discretion, to:
- Place the swap under review for up to 72 hours;
- Request identity verification or proof of funds from the sender before releasing or refunding the swap;
- Refuse to process the swap and return the deposit to the originating address, less any network fees incurred;
- Cancel the swap and cooperate with lawful requests from competent authorities.
The Service does not publish detailed thresholds for this screening.
7. Refunds and Returned Funds
Where the Service cannot complete a swap — due to compliance screening, insufficient liquidity, network errors, or other operational reasons — the Service will return deposited funds to the originating address, less network fees. Refunds to alternative addresses require identity verification of the sender. The Service is not obligated to refund incorrectly addressed or mis-amounted deposits outside of its published refund policy.
8. Prohibited Jurisdictions
The Service is not available to users located in the United States of America, or in any other jurisdiction where use of the Service is prohibited by law. It is your responsibility to determine whether the Service is lawful in your jurisdiction before using it. Users accessing the Service from prohibited jurisdictions do so at their own risk and waive any claim against the Service arising from such access.
9. No Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or continuity of availability. The Service does not warrant that quotes, rates, or fees displayed at any moment will be honored if network conditions or counterparty liquidity change between quote and execution.
10. Limitation of Liability
To the maximum extent permitted by applicable law, neither the Service nor its operators, agents, or affiliates shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of funds, loss of profits, loss of goodwill, or loss of data, whether arising in contract, tort, or any other legal theory, and whether or not the Service was advised of the possibility of such damages. In no event shall the aggregate liability of the Service exceed the network-fee-adjusted amount of the specific swap in dispute.
11. Third-Party Services
The Service may route liquidity through third-party exchanges or liquidity providers. These third parties operate under their own terms and policies. The Service is not responsible for the acts or omissions of third parties, but will act in good faith to recover funds from third-party failures where commercially reasonable.
12. Modifications to These Terms
The Service may update these Terms at any time. Updated Terms are effective upon posting to the Service's public website. Continued use of the Service after such posting constitutes acceptance of the updated Terms. Material changes will be noted at the top of this document.
